Personal Injury

Serious personal injuries caused by traffic accidents and terrorist attacks, or as a result of wrong medical treatment, fundamentally change the lives of victims, their families and relatives. This requires a holistic claims and compensation management that takes into account the victim's legal claims for compensation for pain and suffering, medical treatment, rehabilitation and care measures. It considers also the situation of the injured party and relatives, develops rehabilitation strategies and incorporates this into the regulation. In serious and complex personal injury cases with national and international reference, it is important to enter into a settlement dialogue with the party liable and the respondent on remuneration and rehabilitation at an early stage.  

Property Damage

Complex property and construction damage followed by business interruption may threaten projects and operations. This requires detailed factual and technical investigations and legal evaluation of insurance coverage, insured values and scope of insurance; it is necessary to act quickly and in a solution-oriented manner. Economic and technical understanding, cooperation with experts, surveyors and reconstruction officers as well as conflict resolution strategies are just as essential as legal evaluation - not only in the case of actual insured losses, but also in the assessment of possible loss-mitigation and prevention strategies.

Mediation

As a method of alternative dispute resolution, mediation offers a structured procedure in which the parties voluntarily and independently strive for a future-oriented solution of a dispute under the guidance of the mediator. Especially in the case of personal injury and property or construction damage, the duration of the settlement of the claims for compensation plays a decisive role. By considering the needs and interests of the parties involved, mediation discloses and includes the circumstances behind a dispute and enhances the basis for a settlement. In contrast to traditional and litigation proceedings, this enables timely, appropriate and future-oriented solutions, which are also more cost-effective in every respect.

  • Advice and negotiation in numerous serious traffic accident cases and in cases of damages to international victims of terrorism, cooperation with rehabilitation services and assessment of compensation claims and benefits.
  • Advising and settling in major international property and construction claims, including business interruption and loss of profit (ALoP), investigation of loss causes, recourse claims and loss-mitigation and loss-prevention measures in cooperation with experts, surveyors and international loss adjusters.
  • Portfolio analysis and audits of liability, property and construction claims as well as due diligence reviews of portfolio transfers, particularily in the areas of motor and medical malpractice liability as well as architect’s and engineer’s liability.

Vita

Legal studies at Albert-Ludwigs-University in Freiburg, Germany, (Law School) and legal clerkship at the Hanseatic Higher Regional Courts in Hamburg and Bremen (1981-1983). 2001 graduation as Master of International Business Law at the University of St. Gallen, Switzerland (M.B.L.-HSG), 2019 training as a mediator at the Center for Mediation in Cologne.
Admitted to the bar in Bremen in 1983 and since 1991 in Munich. From 1984 to 1988 working as in-house counsel in the legal department of Bremer Landesbank in Bremen. In 1988 relocation to Munich to the international construction company Dyckerhoff & Widmann AG as in-house counsel, with a focus on construction and corporate law. After the merger with Walter-Bau AG, Augsburg, from 2001 working as head of the executive office and corporate communications of the merged company.
From 2005 to 2019 as Senior Legal Claims Expert at Swiss Re Europe S.A., German branch in Munich, especially responsible for complex major claims in the area of personal injury and property and construction damages, international claims settlement and alternative dispute resolution.
Lectures on the compensation of traffic and terror victims as well as on property and construction damages at national and international conferences, also on claims management strategies and alternative dispute resolution, acting as arbitrator in various construction disputes.
